THE
JOSTS OF SYDNEY
OWNERS OF 54 CHARLOTTE STREET (1836
to 1971)
-
Thomas Jost
(1799-1853), merchant, purchased the land on January 13,
1836. It then remained
continuously in the hands of the family until November 23, 1971.
-
Thomas, formerly of Sydney, died in Halifax
in 1853, the same date as his will. His real property went to Eliza Susanne
(1807-1895), his wife.
-
Eliza Susanne left
the house, and a store (built c. 1850) located on the same property just to the west,
jointly to her sons
Lewis Edward (1849-1933),
merchant and to
Charles Sidney
(1850-1921), also a merchant.
-
Lewis sold the house
and property on March 15, 1920, to
Allan Davidson (1871-1933), druggist, son of Joseph Hennigar, son of Eliza Susanne and Thomas Jost.
-
E. Allan Jost
(1917-1999), chartered accountant, adopted son of Allan Davidson, sold the house and property
on November 23, 1971, after which it passed into the hands of a series of private owners.

with fellow ship owners and mariners asked Halifax for a light at Louisbourg
...
Jost and his colleagues were looking for a low fixed light, visible for 6 to
7 miles, that would not be mistaken for the higher, flashing light on
Scatarie Island. The Scatarie light, a landfall for European ships bound for
the St. Lawrence, could be seen for 30 miles.9

the Scottish Bankruptcy law, in an action brought by parties in the old
country, against Mr. Jost, Cape Breton, to recover £ 411, paid to him by

When Dr.
McLeod was inducted as minister of the Mira congregation in October 1850
there were only three small churches within the bounds of his extensive
charge. One near Marion Bridge, one at the head of Catalone Lake and one at
Black Brook, Cow Bay. There was no Presbyterian Church in Sydney then and
any services held in Sydney during the first two years of Dr. McLeod s
ministry were by the courtesy of the Methodists and of the Revd. Jeremiah
Jost, their pastor at that time, conducted in the Methodist Church on North
Charlotte St.

[Katharine
[McLennan] was involved with the Victorian Order of Nurses with raising
money and attending meetings of the VON. World War II saw her activities in
the community increase with her involvement in the Red Cross and blood donor
drives. While she continued to be involved with the Louisbourg Museum and
the acquisition and arrangement of artifacts, Katharine also headed the
blood drive in Sydney. The old Methodist Church, located on North Charlotte
Street in Sydney, was used as the blood donor clinic site. She began
traveling around the island to supervise other clinics. In October of 1943,
Katharine visited a blood donor clinic in New York and gained ideas there to
assist with organization of local clinics. Her contribution to the war
effort saw her making up Prisoner of War parcels.

We regret to
announce the death, at Halifax, on the morning of Tuesday last [August 16],
after a few days illness, of Thomas Jost Esq., formerly of this Town -
intelligence of which was received by Telegraph early on that day. Mr.
Jost's long residence here - the honorable nature of his mercantile pursuits
- his integrity - and his worth in all the relations of life, are too well
and too generally known to even need being recapitulated. Though he had
ceased, latterly, to be an inhabitant of this place, yet his frequent visits
hither, and occasional superintendence of his extensive business in Sydney,
scarcely allowed us to realize that he had removed from among us, but now
that the dread messenger, Death, has removed him from earth, we shall not
fail to estimate his loss. To his bereaved family and friends, we tender our
sincere condolence.

[On September
7, 1789, the Crown granted the land known as "Louisa
Gardens" to Patrick Rooney Nugent, Esquire. This parcel of
land was estimated to be about thirty-five acres. Mr. Nugent
sold this parcel of land to His Excellency, William
Macarmick, Liuetenant [sic: Lieutenant] Governor of the
Island, for the sum of 5 shillings. Mr. Macarmick died
intestate and his daughter Catherine sold "Louisa Gardens"
to Mr. George Edward Burchell. On December 29, 1885 Mr.
George Edward Burchell sold "Louisa Gardens" to his brother
Mr. James Thomas Burchell for the sum of $200.00. On May 21,
1903 part of the parcel of land formerly known as "Louisa
Gardens" was sold by Mr. James T. Burchell and his wife
Suzannah to Mr. William MacVay for one dollar. Mr. MacVay
was a bricklayer who moved here from New Brunswick to work
at the Dominion Iron and Steel Co. The lot by this time had
been subdivided and was now only 41 feet by 100 feet. Mr.
MacVay took out a mortgage in 1903 and built this house [at
115 George St].

1 - A petition was filed today in the divorce court by Chas.
S. jost, merchant, of Sydney, C.B. from his wife on the
following grounds. On April 6, 1891, she left home and has
not since returned. During the winter of 1891 and at other
times, the petition alleges, she kept company with E.T.
TRITES, who paid her particular attention. Mrs. jost is also
charged with keeping company with one O.E. SMITH, also with
flirting with Chas. DAVIS, mechanical engineer at Stellarton.
It may be necessary to say, in order to avoid possible
misunderstanding because of the similarity of names, that
none of the above are Moncton parties.

L.E. JOST, 79, VETERAN SYDNEY BUSINESS MAN ...
Not only mentally alert [in 1927], but physically very active
for a man of his years. As a matter of fact the interviewer
found him engaged, with W.P. BROWN, another veteran of about the
same years, shingling a portion of the roof of his dwelling, 15
feet above ground, without the aid of staging ...
Mr. Jost was born in Sydney in 1848, but when about nine months
old was taken by his family to Halifax, where re resided for
many years ...
"When I had saved $1000, I went into business for myself, with
another young man. We had our shop on Granville Street. I
remained in Halifax until 1894 when I returned to Sydney and
entered business here." [with his brother Charles E Jost?]
Between the time when he went to Halifax as a child and his
return here to go into business he spent about two years in
Sydney working for his uncle [[James
William Jost, 1807-1880], who conducted a store here. Mr. Jost pointed out a number of interesting landmarks in the street
near his home [61
Esplanade], which at one time was in the centre of the retail
business of the town of Sydney. The Ingrahams were the first to
venture up town, and when they built on the corner of Prince and
Charlotte streets, where Nathanson's book store now stands,
people considered that they were moving out into the country.
Others followed, and gradually business all moved out into Ward
2 and Ward 1 became almost purely residential, some of the old
stores being turned into dwellings.
"I built this house by day's work at a total cost of about
$1,600," he said. "The same type of dwelling, built as solidly,
would today cost at least $5,000 and maybe more. I was offered
$6,000 for it during the steel boom in 1901-2, but did not part
with it because I always like to live where I could over look
the harbour."

- Municipality Of Cape Breton v. Jost.
Before
Henry, J., (at Sydney, C B.)
The wife
of defendant left him, and defendant published a notice that
he would not be responsible for any debts incurred by her.
She subsequently became insane, and was maintained by the
Commissioners of Public Charities, who claimed from the
plaintiff municipality payment for her maintenance. The
plaintiff municipality paid the claim and then sued the
defendant.
Held,
that as the defendant, when his wife became insane, became
directly liable to the Commissioners of Public Charities for
her maintenance, the payment made by the plaintiff
municipality must be regarded as voluntary, and judgment
should be entered for defendant.

I have
come to the conclusion in this case that there must be
judgment for the defendant.
I cannot
see that any legal liability on the part of the plaintiff
Municipality has been shown, and such alleged liability
constitutes the basis of the action as laid, and would be,
under the circumstances in proof, an essential element in
the material for any action which could be brought by the
Municipality to recover the claim in question.
A perusal
of section 25 of the Act (Ch. 38 R. S.) will show, that the
conditions necessary to make the Municipality liable for the
care and maintenance of the defendant's wife at the
Provincial Hospital for the Insane, were not present in this
case.
Moreover,
section 23 shows that the plaintiff Municipality, instead of
recognizing the claim against them, should have shown that
the defendant's wife was not chargeable to the County of
Cape Breton, but to her husband.
I am of
the opinion that the defendant became directly liable to the
Commissioners of Public Charities for the care and
maintenance of his wife under the circumstances in proof,
notwithstanding the publication of the notice on which he
relies, because, although by leaving him, as shown by the
evidence, she would, upon proper notice on his part become
disentitled to make him liable for necessaries, that
disability would cease to exist upon her becoming non compos
mentis, a condition which obviously negatives the
continuance of that (responsible) attitude of rebellious
desertion which disentitles a married woman to that kind of
protection which the law as to necessaries affords her.
With
these views, it appears to me that the recognition by the
plaintiff Municipality of the claim of the Commissioners of
Public Charities, in connection with the care and
maintenance of defendant's wife at the Provincial Hospital
for the Insane, must be regarded as voluntary, and that,
therefore, judgment should be entered for the defendant,
with costs.

Maintenance — Commissioners of Public Charities—Voluntary
payment to. by municipality—Right to recover from lunatic's
husband.]—The wife of the defendant left him. and the
defendant published a notice that he would not be
responsible for any debts incurred by her. She subsequently
became insane, and was maintained by the Commissioners of
Public Charities, who claimed from the plaintiff
municipality payment for her maintenance. The plaintiff
municipality paid the claim and then sued the defendant:
—Held, that, as the defendant, when his wife became insane,
became directly liable to the Commissioners of Public
Charities for her maintenance, the payment made by the
plaintiff municipality must be regarded as voluntary, and
judgment should be entered for the defendant. Municipality

How to Use This
List NAMES and addresses of the students are arranged in the following manner:
The first
column rives the name of the student and the last two figures of the year in
which he was enrolled. The second column gives his address, the third column
indicates the course taken, and the fourth column shows the number of
subjects and drawing plates he has completed, and also whether he has
received a certificate of proficiency or a diploma. In those cases in which
there are ten or more students whose names are given on this list in one
town or city, the name of the town or city is printed in bold-face type over
the second column. It is then followed by the name of the county in Small
Caps. When the number of students is less than ten in any one town or city,
the name of the town or city in which the student resides is printed first,
and is followed by the street and number, if any, and followed again by the
name of the county printed in Small Caps. The name of the state, or country
in case of foreign countries, is printed at the top of each page, when
practicable, and in the case of the Dominion of Canada, it is followed by
the name of the province. The cities and towns are then arranged
alphabetically according to the states or provinces, and can be readily
located as soon as the state or province has been found.
In
explanation of the third column, it may be stated that in order to
distinguish our students and to tell in all cases what course each is
taking, whether it is a revised course or an old course, etc., we give each
student what we call a "class letter," and also an identification number.
This class
letter is usually limited to one or two letters, but may, in a few cases,
consist of three letters. These class letters and numbers are given in the
third column, and are followed in the fourth column by abbreviations
indicating the number of subjects completed, the number of drawing plates
completed, and whether the student has a diploma or certificate of
proficiency. The number of subjects is indicated by the number preceding the
letter S. The number of plates is indicated by the number preceding the
letter P. If the student has a diploma, the preceding abbreviations are
followed by the letter D, and if he has a certificate of proficiency, the
letter С is used instead of D. There is really very little difference
between our diploma and our certificate of proficiency. The diploma we
reserve for the longer and more difficult courses, and the certificate of
proficiency is issued to students that have completed single subjects or

singles 11-9, 4-6, 6-2. Ouseley was defeated by Captain Beatty 6-3, 6-1, Ouseley
and Ross won from Murray and Barnes 6-1, 6-2 Burchell and Jost won from Outway
and McKinnon 6-2, 6-3
The Sydney team drew against
one another. Ouseley and Ross playing Jost and Burchell. This puts one Sydney

DEATH OF JOS. MATHESON
The death of Joseph
Matheson, ex-M.P.P., L'Ardoise, a well known public man of Richmond county,
occurred at his home at that place yesterday. Mr. Matheson, who is 83 years
of age, had been active in Richmond county politics for a period of some 30
years up to 1904, when he retired into private life. In the elections of
1878 and 1882 he was an unsuccessful candidate for a seat in the local
house, but was elected in 1886 and again in 1890. In 1894 he was defeated by
John Morrison of St. Peters. The latter, however, being unseated, Mr.
Matheson was again successful in the ensuing election. He retired from the
local assembly in 1897, and in 1900 was elected to the Dominion parliament,
defeating J.A. Gillies, K.C., the sitting member. In 1904 Mr. Matheson
definitely retired from politics and has lived a retired life at his home at
L'Ardoise. His wife predeceased him some years ago. Mrs. L.E. Jost of
Sydney, a sister-in-law of the late Mr. Matheson, left by this morning's
train to attend the funeral.

Everett Allan Jost
81, Sydney River
Everett Allan Jost, 81, formerly of
Carmichael Drive, Sydney River, passed away Monday, March 1, 1999, at Camphill
Hospital, Halifax. Born in The Dalles, Oregon, he was a son of the late Allan D.
and Grace Johnson (Harris) Jost. He was a member of Christ Anglican Parish,
Sydney. He was a retired chartered accountant. He was a past president and
honoured member of the Kiwanis Club of Sydney, past director of the Cape Breton
Royal Yacht Club, past director of the Sydney Curling Club and past director of
Lingan Golf and Country Club. He was active with the Canadian Red Cross, the
VON, and a member of Yendys Investment Club. Mr. Jost was a veteran of the
Second World War, serving with the Royal Canadian Navy. He is survived by his
wife, Constance (Compton) North; three sons, Allan and Philip, both of Bedford,
Robin, Switzerland and eight grandchildren.
He was predeceased by his first wife,
Marjorie Campbell and one sister, Kathleen. Visitation will be held in Christ
Church, Thursday from 2-4, 7-9 p.m. where funeral will be held 10 a.m. Friday
with Rev. Glenn Kent officiating. Interment in Hardwood Hill Cemetery, under the
direction of Sydney Memorial Chapel. Memorials may be made to the Canadian
Cancer Society
