Mr Bainbridge, absent
Waited from 10 to 12 oclock, when it was presumed that neither Mr Bainbridge, or Mr Sparrow meant to appear __ and the Referees proceeded to examine Some Papers produced by Desbarres relative to Sparrow's accusation of having made a double charge on government by a Bill of Parcels [of] Sparrow's Invoice pr Schooner Swallow £692 consisting of Sundry Articles which he said were fictitious and never existed.
Sparrow, with his attorney [Rd] Brewer attended at 1/4 past 12 oclock.
The Bonds of Arbitration, upon Account of Sparrow Books of Vouchers not yet being arrived from America, were enlarged for that purpose to the 8 of Novr
Desbarres was directed to deliver to Sparrow an account of his charges, and Points wherein he differed from Sparrow's accots delivered in also of all Such matters as he means to come forward, in Charge, to be examined under the Reference.
Sparrow was directed to send for and produce all Such vouchers as can be produced, being Bill of Parcells, du ^ of the goods & Provisions furnished [p. 1198] to Gov D __, specifying the Prices at which they were sold by the merchants to him, Sparrow as Agent, acting with a Commission Profit.
Desbarres produced an Invoice of General [Artillery] Sent him (pr Schooner Swallow) both on his own, and the Government Account __ and shewed that an entry had been made by Sparrow of such articles as made up the amount of which he called an fictitious account which was taking more than what was denied to be done __ i.e. to Select the government Charge from the private one, made for Supplies to Govr D and to draw on government, on that account, to such an Amount as was stated to be false. £493.7.5
