This
Indenture made the first-day of December in the year of our Lord one thousand
Seven hundred and Ninety Eight between Samuel Sparrow of Halifax in the Province
of Nova Scotia Merchant of the one part and John Wilson of Sydney in the Island
of Cape Breton Merchant of the other part Witnesseth that for and in
Consideration of Forty Pounds in hand paid by the said John Wilson to the said
Samuel Sparrow the receipt whereof is hereby Acknowledged he the said Samuel
Sparrow hath granted bargained, sold aliened [en fe offer] and Confirmed and by
these Presents doth grant, bargain, sell, alien, [en feoff] and Confirm unto the
said John Wilson all that Certain Tract or parcel of Land known and
distinguished by Lots number ten Eleven and Twelve Situate lying and being on
the South Side of the South West Branch of Sydney River beginning at a Ver Tree,
Three Chains distant from the Western line when produced of of [sic] Lots number
Seven eight and Nine thence to Run by the Magnet South Thirty one degrees East
fifty seven Chains more or less / of four rods each / until it meets the Road
leading to Peters Bay thence along the said Road South Fifty Nine Degrees, West
- Twenty one Chains Thence North Thirty one Degrees West Seventy Seven Chains
more or less to the South West Branch aforesaid thence by the several courses of
said Branch down Stream to the Boundary first mentioned containing in the Whole
by Estimation one Hundred and Forty five Acres more or less Granted by
Government to the Said Samuel Sparrow together with all Houses, out houses,
ways, Rents Issues profits Priviledges and Appurtanances to the said tract or
Parcell of Land belonging or in any [wise] Appertaining with all the Right Title
Claim interest Property and demand of him the said Samuel Sparrow in or to the
same to have and to hold the said Tract or Parcel of Land with the Appurtenances
as afore said, and all the Right title Claim interest Property and demand of him
Samuel Sparrow in or to the same as before Mentioned unto him the said John
Wilson his Heirs and Assigns for ever to his and their only Proper use benefit
and [Le Loof] for ever And the said Samuel Sparrow for himself and his Heirs
doth hereby Covenant with the said John Wilson his Heirs and Assigns that he the
said Samuel Sparrow and his Heirs the said here by granted Tract or Parcel of
land unto him the said John Wilson his Heirs and Assigns against him the said
Samuel Sparrow and his Heirs and against all Persons whomsoever shall and will.
Warrant and for ever defend by these Presents In Witness whereof the Parties to
these Presents have unto set their hands and Seals the day and Year first above mentioned
written
