Re Mortgage on any of my Estates except on Castle Frederick. £4200 to W & Ria 1783.
1n 1786 All the Estates were mortgaged to Geo Rodgers for the purpose of paying (£9500) Debts incurred for Public Service
17July 1786 __ an Agreement between Desbarres & Rodgers executed (now cancelled) was read Shewing the Intent of Such proposed mortgage.
Sparrow went to Halifax in June 1786 and he appears at the Council in Cape Breton in July 1787 __ No public Accts were signed after 3d June 1786 __ which were certified (£14145.14.4) in a Report by Rodgers & Sparrow __ none since offerred to the Council for Examination __ the last meeting of the Council was the 24 Septr 1787 __ Desbarres embarked [p. 1231] for England the 13th Octr 1787

Qry whether the Attachment was warranted under all these Circumstances?
The Court of Equity decided against the Justice of the Attachment, on Application made by Desbarres, and Sparrow then withdrew it.
Attachment was made about 10 Days after Desbarres left the Island __ the Application relative to the Attachment in 1789.
The Attachment no doubt unwarranted Damages on the Attachment proposed by Mr Bainbridge £200 __ agreed
Sparrow asserted that he had refused to pass Desbarres' Accounts, when in Fact no Accots were produced to the Council subsequent to that passed by Sparrow.
